_*Execution of Will – Tstimony of scribe cannot be treated as testimony of an attesting witness. This apart, DW3 scribe of the Will in opening line of cross examination has deposed that he did not know the testator personally. The witness examined from the office of registering authority only produced certified copy of the Will and made a statement on the basis of records without having any knowledge with regard to execution and registration of the Will – It difficult to differ with findings of the First Appellate Court that defendants No. 1 to 4, beneficiaries under the Will have failed to prove the Will, in accordance with law, therefore, estate left behind by “K” would be inherited by his legal heirs on the basis of natural succession and accordingly respondent No. 1 being one of the class-I heirs of the deceased out of nine would be entitle to 1/9th share in the suit land. In this view of the matter – Not find an error much less illegality in the impugned judgment – Appeal dismissed*_

_*वसीयत का निष्पादन – लेखक की गवाही को सत्यापन करने वाले गवाह की गवाही नहीं माना जा सकता। इसके अलावा, वसीयत के DW3 लेखक ने जिरह की शुरूआत में यह बयान दिया है कि वह वसीयतकर्ता को व्यक्तिगत रूप से नहीं जानता था।  पंजीकरण अधिकारी के कार्यालय से जांचे गए गवाह ने केवल वसीयत की प्रमाणित प्रति प्रस्तुत की तथा वसीयत के निष्पादन और पंजीकरण के संबंध में कोई जानकारी न होने पर अभिलेखों के आधार पर बयान दिया – प्रथम अपीलीय न्यायालय के निष्कर्षों से असहमत होना कठिन है कि प्रतिवादी संख्या 1 से 4, वसीयत के तहत लाभार्थी, कानून के अनुसार वसीयत को साबित करने में विफल रहे हैं, इसलिए, “के” द्वारा छोड़ी गई संपत्ति प्राकृतिक उत्तराधिकार के आधार पर उसके कानूनी उत्तराधिकारियों को विरासत में मिलेगी और तदनुसार प्रतिवादी संख्या 1 मृतक के नौ में से वर्ग-I उत्तराधिकारियों में से एक होने के नाते मुकदमे की भूमि में 1/9वें हिस्से का हकदार होगा। मामले के इस दृष्टिकोण से – विवादित निर्णय में कोई त्रुटि नहीं पाई गई, अवैधता तो दूर की बात है – अपील खारिज*_
