_*Sections 302 and 201 IPC  Murder Concealment of evidence Cause of death is based on a belated postmortem report which is  not corroborated by corresponding field notes of postmortem doctor  Findings with regard to injuries on the mouth, lips and forehead are not supported by another medical officer, PW8 – Though the postmortem doctor claimed death was due to smothering and neck compression, no injuries were found on the neck – Viscera report, the most clinching evidence, has not been produced to rule out a case of poisoning – Trial Court failed to appreciate that a criminal case is not decided on _ preponderance of probabilities – It is the primary duty of the prosecution to prove its case beyond doubt – Failure of the defence to probabilise its version would not be a ground to hold that the prosecution case of homicide by smothering and compression of neck is proved beyond doubt – Appellant is entitled to the benefit of doubt – Appeal allowed. _*धारा 302 और 201 आईपीसी हत्या साक्ष्य को छिपाना मृत्यु का कारण एक विलम्बित पोस्टमार्टम रिपोर्ट पर आधारित है, जिसकी पुष्टि पोस्टमार्टम डॉक्टर के संगत फील्ड नोट्स द्वारा नहीं की गई है मुंह, होंठ और माथे पर चोटों के संबंध में निष्कर्ष एक अन्य चिकित्सा अधिकारी, पीडब्लू 8 द्वारा समर्थित नहीं हैं – हालांकि पोस्टमार्टम डॉक्टर ने दावा किया कि मौत गला घोंटने और गर्दन के दबाव के कारण हुई थी, गर्दन पर कोई चोट नहीं पाई गई – विसरा रिपोर्ट, सबसे निर्णायक सबूत, जहर के मामले को खारिज करने के लिए प्रस्तुत नहीं किया गया है – ट्रायल कोर्ट यह समझने में विफल रहा कि आपराधिक मामला _ संभावनाओं की प्रबलता पर तय नहीं किया जाता है – अभियोजन पक्ष का यह प्राथमिक कर्तव्य है कि वह अपने मामले को संदेह से परे साबित करे – बचाव पक्ष द्वारा अपने संस्करण को संभाव्य बनाने में विफलता यह मानने का आधार नहीं होगी कि गला घोंटने और गर्दन के दबाव द्वारा हत्या का अभियोजन पक्ष का मामला सही है  संदेह से परे साबित हुआ – अपीलकर्ता संदेह का लाभ पाने का हकदार है – अपील स्वीकार की गई। [पैरा 28, 30 और 31*_
