_*Section 438 CRPC  Section 377 IPC  POCSO ACT  Sections 3 and 4 – Anticipatory Bail – Unnatural Sex – Victim was less than 18 years of age and the petitioner committed unnatural act with the victim – During the trial, the victim and his father are declared hostile – In view of the fact that the material witnesses have retracted from their previous statements while appearing in the witness box, no purpose is going to be served by subjecting the petitioner to custodial interrogation at this point of time – Without commenting on the merits of the case, the present petition is allowed and order of interim bail is hereby made absolute subject to the conditions as envisaged under Section 438(2) Cr.P.C*_
